I lead the Solicitor's Philadelphia Region which provides legal services for the component agencies of the US Department of Labor (DOL) in the states of Pennsylvania, Delaware, Maryland, Virginia, West Virginia, and the District of Columbia. The Region has a primary office in Philadelphia, Pennsylvania and a branch office in Arlington, Virginia. I am responsible for initiating and directing all litigation enforcing labor, employment-fairness and regulatory laws enforced by the Department and providing legal advisory services to the ranking Departmental officials in my Region. I direct the work of a staff of approximately 45 attorneys and support personnel in connection with the prosecution of cases enforcing federal labor and employment laws. I approve all litigation, evaluate investigation findings for my regional clients, and administer my regional budget, insuring that appropriated budgets are expended in accord with the law. My staff has tried over a hundred of cases each year recovering hundreds of millions in back wages, damages and fines for tens of thousands of workers..
I direct all litigation filed in the United States District Courts within my Region and before Administrative tribunals pursuant to the Department's many remedial labor and employment statutes including the Fair Labor Standards Act, the Mine Safety and Health Act, the Occupational Safety and Health Act, the Black Lung Benefits Act, Executive Order 11246, the Davis-Bacon Act (and related Acts) and the Employment Retirement Income Security Act. My staff also provides legal advice and assistance to the DOL enforcement agencies on investigations and compliance audits, represents the Department with other federal agencies in the Regions and coordinates with the Office of the Solicitor National Office Divisions and the other Regional Solicitor's offices regarding enforcement strategy and tactics.
As Safety and Health Counsel I was responsible for the initial review and assignment of cases, to staff attorneys, arising under the Occupational Safety and Health Act and Mine Safety and Health Act in the states of Missouri, Kansas, Iowa and Nebraska. As counsel I also; 1) served as liaison with the various Regional Administrators, MSHA District Directors, Assistant Regional Administrators, Deputy District Directors and Area Directors engaged in enforcement of the Acts; (2) established internal administrative systems to ensure internal deadlines were met; (3) monitored the progress of all cases within the my counsel area and maintained the appropriate statistical data; (4) provided advice and recommended suitable litigation and I provided legal opinions and interpretations dealing with the laws administered by my office.
Obtained the largest civil penalty awarded by a Review Commission ALJ in the history of the Kansas City Regional Solicitor's. Acting as lead counsel in this willful-egregious case, I supervised and directed the work of a 13 person litigation team during discovery and 19 days of trial. We recovered $1.2 million in penalties. Tried four cases and seven evidentiary hearings in Federal District courts. I have litigated over 20 additional cases in Federal Court to positive resolutions. I have acted as lead counsel in over fifty cases tried in various Federal District and Administrative Courts and other federal tribunals in my region.
