I review legal instruments and supporting documents for completeness of information, proper execution, certification and technical details.I obtain additional data or information to reconcile discrepancies to include determining whether the action sought by the party submitting the instrument corresponds with governing regulations, procedures and other criteria. This may involve searching highly specialized records to determine if any conditions exist that might stop approval.

As a LIE I am responsible for making administrative and quasi-legal decisions involving overall supervision of beneficiary estates and the protection for benefit rights.I review monetary needs of beneficiaries and adjust allowances when court action is not required.I authorize liquidation of bonds and release of funds from restricted accounts. I initiate and respond to correspondence pertaining to individual estate supervision; initiate action to have payments adjusted, suspended, resumed or recovered when appropriate.

I request field examinations on problem cases; develop missing Veteran cases; identify legal problems of action by Office of Regional Counsel opinion and actions, needed actions and legal documentation.I take prompt action to alleviate hardship, make prompt payments and assure legal and regulatory requirements are met.I have experience reviewing findings of psychiatric and/or court determinations of incompetence by means of field investigations to help arrive at independent determinations of whether or not adult VA beneficiaries have the mental capacity to handle their own funds. I process appointment field examinations and aid in fully developing material facts.I process the certification of the payee's legal right to receive and disburse incompetent beneficiaries VA benefits.After review of examination I initiate investigations into possible misuse of funds, fraud or other situations detrimental to the beneficiary's welfare.

  • Specific duties are as follows: Analyzes and makes the final determination of the competency of veterans and other VA beneficiaries and provides the final notification of the determination.
  • Generates the award for the retroactive payment release, once a fiduciary is established, as well as other award actions needed by the Fiduciary Program.
  • Authorizes, reviews and approves the pending award action for technical accuracy, clarity, and thoroughness.
  • Insures that estate protection is in place, when appropriate, before releasing large retroactive payments and in other cases where the VA beneficiary's funds may not be adequately protected.
  • Prepares Statements of the Case (SOC) on Fiduciary Program appeals.
  • Provides training to other members of the Fiduciary Hub, VARO employees, service organization personnel, and other stakeholders, as needed.
  • Serves as a Veterans Service Representative (VSR) and Legal Instruments Examiner (LIE) expert and provides technical guidance in regard to the rating, generation and authorization of Fiduciary Program awards.
  • Utilizes various electronic data processing (EDP) systems for processing, monitoring, and correspondence preparation.
  • Communicates directly with VA beneficiaries, eligible individuals, representatives, and advocates to explain the full range of VA benefits and all related programs.
  • Gives final approval of accounts received from guardians, attorneys, legal custodians, or chief officers of state institutions except those showing a major account deficiency which cannot be remedied by correspondence.
  • Approval is only given if the accounting is proper in every respect including commissions and/or fees within statutory or policy limits.
  • Advises fiduciaries of regulations, necessary documentation and other factors which affect computation of income for VA purposes.
  • Prepares reports for guardians in those cases in which VA is rendering legal services.
  • Refers to the Office of the Inspector General (OIG), accounts in which there is a possible indication of fraud, embezzlement or other criminal offense.

  • I am a Legal Instrument Examiner charged with running the Fidhub' s Congressional affairs program and serves as the subject matter expert on all areas of developing and maintaining effective Congressional relations.
  • I advised management regarding the interests of Congressional members in Fiduciary matters, and I worked diligently to serve Veterans, beneficiaries and fiduciaries.
  • I have timely responded to over 500 Congressional and VA Central Office Intranet Quorums while I was assigned as the Congressional Liaison.
  • I processed many cases well in advance of suspense dates.
  • I effectively self-generated written VA responses to Central Office Inquiries and Congressional Inquiries for the Regional Office Director and the Fiduciary Hub Manager.
  • Additional duty- Promulgation LIE I am currently one of three Legal Instruments Examiners detailed to promulgate award letters for payment of Veterans and beneficiaries retro benefits.
  • I have promulgated over 150 letters for release of over one million dollars in Veterans and beneficiaries withheld funds.
  • I promulgate compensation cases that need expedited releases such as: Congressional Hardships Terminal Homelessness Evictions.
